You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify webberk immediately at [email protected] of any unauthorized use or security breach.
All transactions initiated through webberk are subject to verification and may be delayed, held, or declined at webberk's discretion for compliance or security reasons. Fees applicable to your account tier are disclosed in your account agreement and may be updated with 30 days' prior notice. You authorize webberk to debit your account for any fees incurred.
All content, trademarks, logos, software, and materials available on the webberk platform are the exclusive property of webberk or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission from webberk.
You agree not to use webberk's services for any unlawful purpose, including money laundering, fraud, financing of terrorism, or any activity that violates applicable financial regulations. You may not attempt to gain unauthorized access to any part of the platform, introduce malicious code, or engage in any conduct that disrupts service availability.
Your use of webberk's services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described therein. Please review our Privacy Policy at any time via your account settings.
webberk's services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or uninterrupted access. webberk does not warrant that the platform will be error-free or free of viruses or other harmful components.
To the fullest extent permitted by law, webberk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services, even if advised of the possibility of such damages. webberk's total liability to you for any direct damages shall not exceed the amount of fees paid by you in the three months preceding the claim.
webberk may suspend or terminate your account and access to services at any time, with or without cause, upon notice where practicable. Upon termination, your right to use the services ceases immediately, and webberk may retain your data as required by applicable law or regulatory obligations.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Wilmington, Delaware.
webberk reserves the right to update or modify these Terms at any time. We will notify registered users of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the services after changes take effect constitutes your acceptance of the revised Terms.
